Terms of use
These terms govern the use of Ridermarkt, a platform where private individuals in Germany buy and sell used kite, wing and foil gear.
1. The role of Ridermarkt
Ridermarkt connects buyers and sellers and offers a protected payment through Stripe. The sale is concluded between buyer and seller; Ridermarkt is neither the seller nor an agent for the gear offered. Sales between private individuals do not carry the statutory right of withdrawal that applies to purchases from businesses; Ridermarkt’s buyer protection applies instead.
2. Account
One account per person, with an identity verified by Stripe. You are at least 18, you live in Germany and your details are accurate. Shops, schools and clubs register in the name of the person in charge and flag the account as professional.
3. Listings
You only sell gear you own, with an honest description and real photos, defects included. Stolen or prohibited goods, counterfeits and listings without gear are forbidden. Listings are checked before first publication and may be removed.
4. Payment and fees
Payment happens only through the platform, by card. Selling is free with no commission; Stripe’s payment fees (about 1.5 to 3%) are deducted from the amount paid out to the seller; the buyer pays the protection fee (€2 + 5 %), shown before payment. Stripe holds the money until handover; the rules on handover, deadlines and disputes are on the Buyer protection page.
5. Conduct
No scams, harassment or attempts to arrange payment outside the platform. In case of abuse we may remove listings, block payouts and close accounts. You can challenge a decision by writing to kontakt@ridermarkt.de; we reply within 14 days.
6. Tax
Occasionally selling your own belongings is usually not taxable, but German law (PStTG, implementing the EU directive DAC7) requires us to report to the Federal Central Tax Office each year the sales of sellers exceeding 30 sales or €2,000 per year. We will let you know if this applies to you.
7. Liability and governing law
Ridermarkt is not liable for the condition of the gear sold or for arrangements made outside the platform, but decides disputes under the buyer protection rules. Operator: Eliès Mohammed-Amine Somaï, established in Switzerland. Swiss law applies, without depriving consumers in Germany of the mandatory protections of their own country; they may bring claims before the courts of their place of residence. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
8. Changes
We may update these terms; material changes are announced by e-mail 30 days in advance.
Draft under legal review.
